Saskatchewan Will Checklist
Ensure your will is legal, enforceable, and protects your wishes.
Here’s a simple checklist for writing a valid will in Saskatchewan, based on provincial laws and best practices:
You Must Be Eligible
- You are 18 years or older (or married/member of armed forces).
- You are mentally competent and understand what a will is.
Decide on the Format
Choose one of the following types:
- Formal (Typed or Printed) Will
- Prepared on a computer or typed.
- Signed in the presence of two witnesses.
- Both witnesses sign in presence of the testator and each other.
- Witnesses are not beneficiaries or married to one.
OR
- Holograph (Handwritten) Will
- Entirely written by hand (not typed).
- Signed by you.
- No witnesses required, but should be clear and complete.
NOTE: Holograph wills are legally valid in Saskatchewan but riskier and more easily challenged.
Clearly State Your Intentions
Include the following:
- A statement that this is your last will and testament.
- Your full legal name and address.
- The revocation of any previous wills.
- Name an executor (the person who carries out your wishes).
- List your beneficiaries (who gets what).
- Describe specific gifts, if any (e.g., jewelry, heirlooms).
- Instructions for residual estate (everything else).
- Appoint a guardian for minor children (if applicable).
Sign & Witness
For a formal will:
- You sign the will at the end.
- Two witnesses watch you sign.
- Witnesses then sign in your presence and each other’s.
Store Your Will Safely
- Keep the original in a safe but accessible place.
- Tell your executor where to find it.
- Avoid making handwritten notes or changes after signing.
Review Your Will Regularly
- After major life changes (marriage, divorce, birth of children).
- Every 3–5 years to ensure it still reflects your wishes.
