What is a will and what does it do?
A will is a legal document that takes effect after your death. It allows you to name an executor, choose who inherits your assets (like money, property, and possessions), and appoint guardians for minor children.
Without a will, a court will appoint an administrator and your assets will be distributed according to provincial laws, not your wishes.
What are the requirements to create a will?
- Age: You must be at least 18 years old, unless you are a minor who is married or has been in a relationship for at least two continuous years.
- Mental capacity: You must be of “sound mind,” meaning you understand what a will is, the types of property you own, who you are leaving it to, and the consequences of signing the will.
- Form: The will must be in writing, signed by you, and signed by two witnesses who are not beneficiaries.
Is a handwritten will legal in Saskatchewan?
The will must be completely in your handwriting or printed by you. iit cannot be typed out, even partially. However, printing by hand is allowed. You must clearly indicate who you are leaving property to. You must sign and date the will.
What should I consider when planning my will?
- Your estate: Make a comprehensive list of all your assets (property, bank accounts, investments, vehicles, etc.) and estimate their value.
- Your beneficiaries: Decide who you want to inherit your assets. Consider what should happen if a beneficiary dies before you.
- Specific gifts: Think about any specific items or monetary gifts you want to leave to individuals or charities.
- Guardianship: If you have children, appoint a guardian to care for them.
- Executor: Choose someone you trust to be your executor, the person responsible for carrying out the instructions in your will.
- Updating your will: Your will should be updated whenever your circumstances change, such as after a marriage, divorce, or the birth of a child.
